Cross-border activities and transfers

This section provides an overview of the Italian legislation and regulation that IORPs established in another Member State of the European Union must comply with when they have the intention to operate in Italy on a cross-border basis (“Guest IORPs”), under articles 11 and 12 of the Directive (EU) 2016/2341 (the IORP II Directive); it includes also the links to the official texts.

You will also find useful information on the provisions of prudential nature in force in the EU Member States which are not covered by the reference to the national social and labour law (SLL).

Finally, you will find the official text of the Decision of the Board of Supervisors no. 18-321 on collaboration of the competent authorities of the Member States of the European Economic Area (EEA) with regard to Directive (EU) 2016/2341 of the European Parliament and of the Council of 14 December 2016 on the activities and supervision of institutions for occupational retirement provision (IORPs) and of the relevant Annexes and Appendices (so called Revised Budapest Protocol). The document, signed by the EU National Authorities responsible for IORPs’ supervision – including COVIP –, details the means and procedures for the collaboration between National Competent Authorities (NCAs) in case of IORPs’ cross-border operations.
